Terms of Service

1. Acceptance of Terms

By creating an account on Nepal Untrodden ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not register or use the Platform. These Terms apply to all users, including travellers, hosts, guides, and agencies.

2. Platform Description

Nepal Untrodden is a discovery and connection platform that facilitates direct bookings between travellers and local hosts, guides, and trekking agencies in Nepal. The Platform acts as an intermediary to connect parties but is not a travel agency, tour operator, or party to any booking contract made between a traveller and a host.

The Platform is currently in an alpha phase. Features, policies, pricing structures, and commission rates are subject to change. Existing users will be notified in advance of any material changes that affect their use of the Platform.

3. User Accounts

• You must provide accurate, current, and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• Host accounts require admin approval before activation. Approval may be refused at the Platform's discretion.
• You must be at least 18 years of age to create an account.
• Accounts may not be transferred or shared with other individuals.

4. Host Obligations

By registering as a host, you declare and agree to the following:

• All information provided in your listings is accurate, truthful, and not misleading.
• You hold all necessary permits, licences, and registrations required by Nepal Tourism Board and relevant local authorities.
• You comply with all applicable Nepali laws and regulations regarding tourism, employment, and health and safety.
• Guides and porters employed in connection with your listings are paid in accordance with Nepal Tourism Board minimum wage standards and are covered by appropriate personal accident insurance.
• Homestay facilities meet the hygiene and quality standards described in your listing, including clean and adequate toilet and kitchen facilities for guests.
• You will not engage in discriminatory practices on the basis of race, religion, nationality, gender, disability, or sexual orientation.
• You will respond to booking enquiries and confirmed bookings in a timely and professional manner.

5. Traveller Obligations

• You agree to treat hosts, guides, and local communities with respect and cultural sensitivity.
• You are responsible for ensuring you hold all necessary travel documents, visas, and permits required to enter Nepal and undertake the activities booked.
• You acknowledge that trekking and adventure activities in Nepal carry inherent risks and that you undertake them at your own risk.
• You agree to abide by the cancellation and refund policy communicated by the host at the time of booking.

6. Commission and Fees

A platform service fee of 5% is applied to the total booking value, charged to the traveller at the time of booking. This structure is subject to change, and hosts will be given reasonable advance notice before any commission is introduced.

7. Content and Listings

• All listings are subject to admin review and approval before publication.
• The Platform reserves the right to remove or modify any listing that violates these Terms or misrepresents the experience offered.
• By submitting photographs and descriptions, you grant Nepal Untrodden a non-exclusive licence to display that content on the Platform for the purpose of promoting your listing.

8. Limitation of Liability

Nepal Untrodden is a discovery and booking platform and is not liable for the quality, safety, legality, or accuracy of listings, or for any injury, loss, or damage arising from activities booked through the Platform. The Platform facilitates connections between travellers and independent hosts; the contractual relationship for any booking is between the traveller and the host directly.

9. Privacy

Your personal data is collected and processed solely for the purpose of providing the Platform's services. We do not sell personal data to third parties. Traveller contact information is shared with the relevant host only for the purpose of facilitating a confirmed booking. By creating an account, you consent to receiving transactional emails from Nepal Untrodden related to your bookings and account.

10. Termination

Nepal Untrodden reserves the right to suspend or permanently terminate any account that violates these Terms, engages in fraudulent activity, or causes harm to users or the Platform's reputation. Users may delete their own account at any time by contacting support@nepaluntrodden.com.

11. Governing Law

These Terms are governed by the laws of Nepal. Any disputes arising from use of the Platform shall be subject to the jurisdiction of the courts of Nepal.
